No, an employer can’t review your credit report in California unless the position falls into an exemption. Exemptions include
- positions in the state Department of Justice
- managerial positions
- law enforcement positions
- positions for which the information is required by law
- positions that involves access to specified personal information
- positions in which you are a named signatory on the employer’s bank or credit account
- positions that have access to confidential or proprietary information
- positions that involve regular access to $10,000 or more
If you are a job applicant or employee, the employer who orders your credit report must notify you and provide an explanation of which exemption allows the access.
